The genealogical study shows that eleven probands share common ancestors who lived eight or ten generations ago in these villages. Thus there was probably a founder effect (...) from one pair of ancestors, strengthened by endogamy. In contrast, four probands originate from another area and are not genealogically related. In this book, Robert Sokolowski argues that being a person means to be involved with truth. He shows that human reason is established by syntactic composition in language, pictures, and actions and that we understand things when they are presented to us through syntax. Sokolowski highlights the role of the spoken word in human reason and examines the bodily and neurological basis for human experience. What is compassion? I suggest that it is, as Adam Smith and David Hume once argued, a moral sentiment that is subject to a great many constraints and variations but is nonetheless “natural.” I also consider Nietzsche's rather vehement attack on Mitleid and current social psychological literature on empathy.

There seems to be no end to moralizing about the vices, but there is too little appreciation of them as mere human foibles and an essential part of the “human circus.” There are also serious questions about whether some of the so-called deadly sins are sinful at all.

Too often, since the 19th century, sensitivity is dismissed as mere “sentimentality” in philosophy and in literature. It is charged that sentimentality is distorting, self-indulgent, self-deceptive. I argue that all of these charges are misplaced or themselves distorted and betray a suspicion of emotions and the tender sentiments that is unwarranted.

Do we love for reasons? Most romantics would insist not. In fact, we love despite good reasons not to love. I argue that love necessarily involves reasons. I discuss the problem of loving someone for his or her looks and what I call Plato's Problem, loving only the properties of a person. I end by discussing some dubious and perverse reasons for love.

Spirituality is often dismissed as mere sentimentality. It is also often opposed to science and the scientific worldview, as if the one is anathema to the other. I suggest that spirituality has distinct advantages over religion and is not at all opposed to science or scientific thinking.

This volume collects thirty years worth of articles on the emotions written by the distinguished philosopher Robert Solomon. Solomon's thesis is that we are significantly responsible for our emotions, which are evaluative judgments that in effect we choose. This is the first of several volumes that document work in the emotions.

We criticize the following views: only the rapist is responsible since only he committed the act; no one is responsible since rape is a biological response to stimuli; everyone is responsible since men and women contribute to the rape culture; and patriarchy is responsible but no person or group. We then argue that, in some societies, men are collectively responsible for rape since most benefit from rape and most are similar to the rapist.

Numerous labor-management issues possess ethical dimensions and pose ethical questions. In this article, the authors discuss four labor-management issues that present important contemporary problems: union organizing, labor-management negotiations, employee involvement programs, and union obligations of fair representation. In the authors view, labor and management too often view their ethical obligations as beginning and ending at the law''s boundaries. The main thesis of this article is that Kant’s concept of law is a non-positivistic one, notwithstanding the fact that his legal philosophy includes very strong positivistic elements. My argument takes as its point of departure the distinction of three elements, around which the debate between positivism and non-positivism turns: first, authoritative issuance, second, social efficacy, and, third, moral correctness. All positivistic theories are confined to the first two elements. As soon as a necessary connection between these first two elements (...) and the third element, moral correctness, is established, the picture changes fundamentally. Positivism becomes non-positivism. There exist two kinds of connections between law and morality: classifying and qualifying connections. This distinction stems from different sorts of effects that moral defects give rise to. A classifying connection leads to the loss of legal validity, whereas a qualifying connection leads only to legal defectiveness. In Kant’s theory of law both connections are found. The qualifying connection is conspicuous throughout Kant’s theory of law, whereas the classifying connection, by contrast, is rare and well hidden. This will suffice to consider Kant as a representative of inclusive non-positivism. (shrink)

Thus, in an initial step, I will briefly look at the concept and the nature of law. In a second step, I will attempt to explain what the concept and the nature of law, (...) thus understood, imply for the relation between legal certainty and correctness. Here three issues will be considered: first, the Radbruch formula as an answer to the problem of extreme injustice; second, the special case thesis, which claims that legal argumentation is a special case of general practical argumentation; and, third, the problem of the judicial development of the law.
